Overview

Throughout Florida and the Southeast, our group represents clients regarding diverse environmental issues including, wetlands, sovereign submerged lands, coastal development and resilience, protected species, water quality and water use, as well as property contamination, brownfields, waste management, due diligence, natural resource extraction, wastewater/stormwater management, and beach nourishment.

Our team of environmental and land use attorneys, land use planners, GIS analysts and property appraisers is able to help clients throughout the entire lifecycle of virtually any environmental project. From due diligence prior to acquisition, land development to facilities siting and operation, we collaborate with clients to help secure permits and other authorizations for projects and defend them through administrative and citizen-suit challenges, if needed.

Our clients span a wide range of industries and we understand the complexities of the environmental laws and regulations governing their operations. Our team is regularly involved in state and federal rulemaking and is positioned to counsel clients on regulatory compliance, as well as defend clients in regulatory investigations, enforcement actions, environmental class actions, and toxic torts claims.

Notable Experience

  • Drafted language to codify “grandfathering” in stricter nutrient discharge requirements for new developments, and worked with FDEP to ensure the grandfathering provisions are uniformly applied across all five water management districts. The grandfathering provisions assure regulatory consistency for clients with existing and planned projects.
  • Lead environmental counsel in obtaining a long-term programmatic imperiled species permit covering more than 100,000 acres from the FWC.
  • Lead environmental counsel in obtaining and modifying various listed species permits from FWC and U.S. Fish and Wildlife Service for a Development of Regional Impact covering over 11,000 acres in central Florida.
  • Lead environmental counsel on various permitting projects for Mosaic, the world’s leading integrated producer of concentrated phosphate and potash. We have assisted Mosaic with obtaining state and federal environmental permits needed for several large mine projects and infill projects on over 60,000 acres in Hardee, Hillsborough, Manatee and Desoto Counties, including associated infrastructure corridors; this has included working with a multi-discipline team of consultants, negotiating with state and federal permit agencies, and defending state and federal permit challenges by third parties when filed in both state and federal court.
