Overview
Our consumer law litigation attorneys assist clients in mitigating legal risk and represent them in state and federal government investigations, including investigations by the Federal Trade Commission (FTC) and state attorneys general. We work with clients to understand how they market to customers, identify applicable state and federal laws, and provide guidance and training to correct or improve practices that pose undue risk before enforcers come calling and lawsuits are filed.
We also work closely with clients to ensure their consumer contracts protect them from unfair or unfounded lawsuits. Our team has defended clients across the country against individual and class action lawsuits asserting claims under a variety of consumer protection statutes. We have also crafted and enforced arbitration clauses with class action waivers and defeated motions for class certification, eliminating the risk of large claims for class damages.

- Represented Fortune 100 company as Florida counsel with Quinn Emanuel Urquhart & Sullivan in defending a consumer class action alleging violations of Florida’s Deceptive and Unfair Trade Practices Act (FDUTPA) relating to geolocation tracking with cellphone app; case dismissed with prejudice.
- Defended Fortune 500 companies in FDUTPA class actions relating to various products and services, including sunscreen, flushable wipes, movie rentals, and fuel surcharges.
- Represented Fortune 500 companies in Attorney General Investigations, including car rental, hotel, home improvement, solar, and financial service companies.
- Represented vacation ownership company Bluegreen Vacations Unlimited, Inc. defending against a proposed class action filed in the United States District Court for the Southern District of Florida asserting claims under the Telephone Consumer Protection Act (TCPA) and seeking damages of over $420 million dollars. The district court denied class certification and the Eleventh Circuit affirmed.
- Represented Miami metropolitan business in defending a class action brought under the Telephone Consumer Protection Act (TCPA) in the United States District Court for the Southern District of Florida seeking class-wide damages of approximately $90 million dollars. The district court denied class certification.
