Real Estate Acquisition and Ownership Litigation

  • Counsel sellers and buyers in actions relating to the acquisition of real estate, including prosecution of actions for specific performance
  • Represent owners as well as commercial real estate brokers and agents in all types of lawsuits involving real estate commissions
  • Enforcement and defense in actions involving condominium restrictions, restrictive covenants, use limitations, and claims of easements or other encumbrances of real property
  • Represent property owners in connection with eminent domain claims including takings and valuation issues.

Real Estate Leasing Operations

  • Represent commercial landlords and tenants in all aspects of commercial lease disputes
  • Enforcement of lease exclusivity provisions
  • Negotiate lease termination agreements and enforcement against hold-over tenancies
  • Prosecute and defend commercial leasing commission disputes

Notable Experience

  • Represent lender in successful negotiation of forbearance agreement to resolve distressed $37 million loan secured by multi-family housing in Tampa Bay
  • In a class action, obtained a $100 million settlement from CBRE, Inc. on behalf of commercial property investors whose funds were embezzled by a third party while CBRE was managing the properties.
  • Assisted commercial real estate broker in securing lease commission in connection with opening of world-class South Beach eatery
  • Represent commercial landlord owning $265 million portfolio, consisting of 30 properties, totaling 242,000 square feet in Naples, Florida in all types and aspects of commercial landlord-tenant litigation
  • Advise international banks and counsel with respect to interrelation between foreclosure and UCC non-foreclosure remedies for multilayered, dual collateral loan agreements
