We partner with private and public sector employers to formulate strategies for achieving effective labor relations and other business goals. Our attorneys have “in the trenches” experience advising and representing clients in their dealings with unions seeking to represent blue collar, white collar and professional employees to ensure compliance with the National Labor Relations Act (NLRA) and Florida’s Public Employees Relations Act (PERA).
Range of Services
Union-Free Workplace Strategies
- Develop policies and procedures and advise employers on lawfully maintaining a union-free workplace
- Counsel employers during union organizing campaigns, including managing union certifications and elections
- Manage union decertifications
Collective Bargaining and Negotiations
- Serve as labor negotiators during collective bargaining to help expand operational flexibility and pursue financial goals
Training and Workplace Management
- Train supervisors to avoid unfair labor practice charges and lawsuits and defend unfair labor disputes in court
- Establish positive working relationships with unions already representing clients’ employees
Other Representation and Litigation
- Represent employers before the National Labor Relations Board (NLRB) and Public Employees Relations Committee (PERC) in union representation cases, secondary boycott matters and unfair labor practice litigation
- Represent employers in contractual grievance and arbitration proceedings
- Plan for and represent employers during picketing and strikes, including injunction proceedings
- Advise employers concerning plant closings and work transfers
Notable Matters
- Helped save clients millions of dollars through collective bargaining, administrating union grievances, handling arbitrations, defending unfair labor disputes before the NLRB and managing union certifications and elections.
- Successfully navigated through actual and threatened strikes and other work stoppages.
- Successfully negotiated numerous collective bargaining agreements for unionized clients that were ratified by the respective labor unions without a work stoppage. These labor agreements helped save clients costs by expanding their management rights, restructuring pensions and other future liabilities, and attaining numerous union concessions.
- Conducted hundreds of seminars for clients and professional organizations on how to remain union-free.
