Overview

Albert Lichy is a trial lawyer who represents individuals and businesses in contested commercial disputes across the country. Albert’s recent trial victories include a $50 million jury verdict for golf legend Jack Nicklaus in Palm Beach County Circuit Court and an $8.3 million jury verdict for Perry Ellis International, Inc. in the Complex Business Division of the Miami-Dade County Circuit Court.

Before joining the firm, Albert was a law clerk for the Honorable Thomas L. Ambro, United States Court of Appeals for the Third Circuit, and the Honorable Paul C. Huck, United States District Court for the Southern District of Florida. Albert was also a judicial extern for the Honorable Alex Kozinski, United States Court of Appeals for the Ninth Circuit.

Albert has prior experience as an investment banker at a restructuring advisory boutique in New York City and as a corporate lawyer at one of Wall Street’s top law firms.

Notable Experience

  • Represented golf legend Jack W. Nicklaus in connection with three high-profile lawsuits—all resulting in a victory—against his former namesake, Nicklaus Companies, LLC:
    • A defamation suit in Palm Beach County Circuit Court which resulted in a $50 million jury verdict for Mr. Nicklaus after a three-week jury trial in Palm Beach County Circuit Court
    • A lawsuit filed against Mr. Nicklaus claiming ownership of his name, image and likeness (NIL). Mr. Nicklaus prevailed in a landmark summary judgment ruling in New York state court
    • An arbitration over whether Mr. Nicklaus could compete against his former namesake in connection with golf course design and commercial endorsements. Mr. Nicklaus prevailed after a final arbitration hearing involving dozens of witnesses.
  • Represented Perry Ellis International, Inc. against United Legwear, LLC in an earn-out dispute which ended in a jury verdict of almost $10 million plus an award of attorneys’ fees and costs. This was one of the largest jury verdicts in Miami-Dade County’s Complex Business Division in 2024.
  • Represented Perry Ellis International, Inc. in a lawsuit brought against three hedge funds in connection with Perry Ellis’ 2018 going -private transaction. Perry Ellis achieved a complete victory over the hedge funds on summary judgment in Miami-Dade County’s Complex Business Division. That victory led to major modifications to Florida’s appraisal rights statute. Albert assisted in making those modifications.
  • Successfully defended Perry Ellis International, Inc. against a lawsuit brought by a large publicly traded company seeking to cancel a valuable license agreement after Perry Ellis’ 2018 going-private transaction. The case was resolved after a series of pre-trial rulings in Perry Ellis’ favor.
  • Represented the ClearSky Funds against its financial sponsor, the largest energy company in the world, which launched an attempted takeover of the Funds after disagreements involving the Principals Directors of the Funds. The result was a complete victory for the ClearSky Funds after a 6-week Final Hearing, which involved testimony from over 25 fact witnesses and numerous experts who opined on complex issues of governance and securities laws.
  • Represented Fragomen, Del Rey, Bernsen and Loewy LLP and a member of the Firm’s executive committee in a malpractice action in the 11th Judicial Circuit Court in and for Miami-Dade County, which resulted in a rare dismissal of all malpractice claims brought against Fragomen and the member of the Firm’s executive committee.
