Overview

Daniel focuses his practice on corporate bankruptcy, financial restructuring, and other domestic and cross-border insolvency matters both in and-out of court, including related litigation. He has represented debtors-in-possession (DIP), DIP lenders, committees, creditors, foreign and domestic fiduciaries, indentured trustees, receivers, asset purchasers, and other stakeholders in complex bankruptcy and insolvency proceedings in Florida and across the United States.

Notable Experience

  • Represented foreign representative in obtaining Chapter 15 recognition and interim provisional relief, including an interim asset-freeze order that positioned the matter for a confidential settlement.
  • Represented creditor in litigating claim-objection issues asserted by the trustee of the Third Party Payor Trust created under the confirmed plan.
  • Represented former majority shareholders of a contract research organization (CRO) in a Chapter 11 reorganization and related adversary proceedings against their senior secured lender.
  • Represented DIP lenders in structuring and closing $12.6 million in post-petition financing to support completion and sale of $110 million student-housing project.
  • Represented landlord in a hotel operator’s Chapter 11 case and related adversary proceeding seeking abatement of approximately $3 million in pre- and post-petition rent arising from COVID-19 impacts.
  • Represented strategic buyer in acquiring a West Palm Beach timeshare condominium through a liquidation plan and adversary proceedings to extinguish fractional ownership interests.
  • Represented minority owned and operated linen supplier in a contested confirmation process to restructure approximately $7.5 million in secured and unsecured debt.
  • Represented judgment creditor in an individual debtor’s Chapter 11 case; successfully opposed confirmation on feasibility and good-faith grounds and obtained conversion to Chapter 7.
  • Represented indenture trustee on behalf of bondholders in obtaining appointment of a receivership over a senior living facility; supported the receiver through lien disputes and the sale process culminating in a $17 million sale.
  • Represented lender in a commercial loan enforcement action; obtained summary judgment on all counts and recovered over $1.65 million in principal and interest due under promissory notes.
  • Represented assignee of a distributor of well-drilling equipment, machinery, and supplies in an Assignment for the Benefit of Creditors proceeding.
  • Represented court-appointed joint trustees of UK bankruptcy estate in seeking Chapter 15 recognition of a foreign main proceeding and emergency provisional relief.
  • Represented developer in contesting recognition of Canadian insolvency proceedings of a global supplier of theme-park attractions and rides as a foreign main proceeding.
  • Represented Italian philanthropic foundation in federal proceedings to obtain evidence for use in contemplated Italian litigation; secured discovery relief compelling Florida-based witnesses to produce documents and testimony.
  • Represented floorplan lender in a used-automotive dealership’s Chapter 11 reorganization.
  • Represented foreign representative of a Brazilian debtor in Chapter 15 proceedings stemming from a cryptocurrency pyramid scheme; obtained U.S. recognition of the Brazilian bankruptcy as a foreign main proceeding.
  • Represented modular construction firm in a nondischargeability adversary proceeding against principal of vendor.
  • Defended pharmaceutical company in a Chapter 7 adversary proceeding brought by the trustee asserting preference and fraudulent transfer claims.
  • Represented floorplan lender in the Chapter 11 reorganization of Texas-based Reagor Dykes Auto Group, including contested confirmation proceedings.
