Nicole A. Neugebauer focuses her practice on advising clients on a wide-range of complex land use permitting and entitlement issues, including comprehensive plans and amendments, rezonings, variances, special exceptions, code enforcement, Development of Regional Impact (DRI) review and other related aspects of securing development authorization. In addition to her land use practice, Nicole also represents clients in circuit court and appellate litigation on a variety of land development matters.

Nicole earned her J.D., magna cum laude, from Stetson University College of Law. She earned both her B.A. and B.S., cum laude, from the University of Florida. During law school, Nicole served as a law clerk in the Firm’s Tampa office.

Prior to law school, Nicole worked for a Fortune 500 company in the Real Estate Asset Management department, where she reviewed and summarized title, declarations of covenants, conditions, and restrictions, and easements for company-owned shopping centers. Nicole also worked for the same company in its retail operations throughout high school and college.

Representative Experience

  • Prepared local government rezoning, major modification, variance, and other development order applications and presentations.
  • Drafted memoranda regarding various property rights and civil rights challenges to local government action, including challenging a local government’s unreasonable interpretation of its comprehensive plan.
  • Represented several clients in litigation challenging unreasonable development permit denials or third-party challenges to approved development permits.
  • Represented several clients in Florida Land Use and Environmental Dispute Resolution actions to successfully defend against unreasonable rezoning denials and code enforcement actions.
  • Advised clients pursuing development incentives, including ad valorem tax abatement, brownfields voluntary cleanup tax credits, and jobs tax refunds.
  • Prepared applications to challenge denial of agricultural tax classifications (greenbelting).
